Practice Areas: Copyrights

Copyright is both the weakest and strongest form of Intellectual Property. It only protects the form of expression of a work, and it only prevents copying. It does not protect underlying ideas, and it does not prevent the independent creation of an identical work. Where it does apply, copyright carries some very strong remedies for infringement.

Copyright protects some variations of a copyrighted work. Unlike patents, however, there is no written claim in the Copyright Registration that defines the scope of coverage that a copyrighted work enjoys. Numerous recent statutory changes in the copyright laws have yet to be considered by the Courts. There is significant uncertainty in some areas of copyright law. It requires skill and experience to navigate the uncertainties in this area.

Belasco Jacobs & Townsley, LLP counsels clients in securing copyright protection for their works of authorship as well as in licensing and defending their copyrights in the United States Federal Courts.
